Former President Trump Seeks Top Court Clearance for National Guard Personnel in the State of Illinois

On the last weekday, the government filed an emergency request to the US supreme court, asking for clearance to deploy national guard forces to Illinois.

This action is part of a wider push to widen the domestic use of the troops in a number of urban centers under Democratic control.

Legal Battle Over Troop Deployment

In an immediate request, the US Department of Justice pressed the bench to overturn a previous judicial decision that had stopped the deployment of hundreds of military reserve troops to the Chicago area.

The presiding judge had raised doubts about the White House's justification for sending troops, questioning its reasoning in given regional circumstances.

A appellate court supported the lower court’s decision on Thursday, leaving the deployment on pause while the court case proceeds.

Administration's Arguments

The top government lawyer, representing the administration, claimed in the recent request that federal agents have often been “threatened and assaulted” in the city of Chicago and the suburb of Broadview.

The commander-in-chief has previously dispatched national guard personnel to Chicago and Portland, Oregon, after earlier sendings to LA, Memphis, Tennessee, and Washington, District of Columbia.

The president has stated that troop deployment is necessary to reduce protests and support immigration enforcement.

Democratic officials have vehemently criticized the decision, saying that the president’s claims are overstated and partisan in nature.

They accuse the administration of misusing his executive power to retaliate against critics.

Statutory Grounds

At the core of the legal battle is the president’s use of a federal statute authorizing the commander-in-chief to federalize the state guard only in cases of insurrection or when “incapable with the federal troops to enforce the regulations of the United States”.

The government maintains that the personnel are required to defend federal property and officers from activists.
